Gachagua awaits impeachment verdict as political stakes rise

NAIROBI, Kenya—Former Deputy President Rigathi Gachagua has said he is prepared for any outcome ahead of Monday’s High Court ruling on petitions challenging his impeachment, a decision that could significantly shape Kenya’s political landscape ahead of the 2027 General Election.

Speaking during a church service in Karen, Nairobi, on Sunday, Gachagua expressed confidence in the judiciary while acknowledging that the court could either uphold or overturn his removal from office.

“We are ready for whatever outcome,” he said, adding that he would respect the court’s decision and pursue further legal avenues if necessary.

The three-judge bench is expected to deliver its verdict on consolidated petitions challenging the legality and constitutionality of Gachagua’s October 2024 impeachment by the National Assembly and the Senate.

The ruling is being closely watched not only because it concerns the fate of a former Deputy President, but also because it could establish important legal precedents on impeachment procedures, public participation and due process in Kenya.

Throughout the proceedings, Gachagua’s legal team argued that constitutional safeguards were not fully observed during the impeachment process. They contended that he was denied a fair opportunity to defend himself and that the process was conducted in a manner that compromised procedural fairness.

The respondents, including Parliament, the Senate and Deputy President Kithure Kindiki, have rejected those claims, maintaining that the impeachment complied with constitutional requirements and that Gachagua was accorded a fair hearing.

Beyond the courtroom, the case has evolved into a major political contest.

Since his removal from office, Gachagua has remained an influential figure, particularly in the Mt Kenya region, where he has continued to engage supporters and position himself as a key voice in national politics. Political observers say the court’s decision could influence his future role and shape political alignments as the country gradually shifts focus towards the next election cycle.

A ruling in his favour would likely be interpreted by his supporters as vindication and could strengthen his political standing. On the other hand, a decision upholding the impeachment would leave him relying on the appellate process while continuing to build his political influence outside government.

Despite the heightened political interest surrounding the matter, Gachagua called on his supporters to remain peaceful regardless of the outcome.

“I want to urge my supporters that, irrespective of the outcome, to remain calm and peaceful,” he said.

The former Deputy President is seeking declarations that his impeachment was unconstitutional and unlawful, alongside compensation equivalent to the salary and benefits he would have earned had he completed his five-year term.

As the country awaits the verdict, attention is focused not only on Gachagua’s political future but also on what the judgment may reveal about the evolving relationship between politics, accountability and constitutional governance in Kenya.
